- On resignation the seniority premium is only due after 15 years (art. 162 sec. III LFT). If you were dismissed without cause, use the severance calculator.
A finiquito is the final settlement every employee in Mexico receives when the job ends, whether you resign, your fixed-term contract expires or you are let go. It is not a bonus or severance. It pays what you have already earned: unpaid salary days, the aguinaldo (Mexico’s statutory year-end bonus of at least 15 days) pro-rated from 1 January, vacation days accrued since your last work anniversary under article 76 of the Federal Labour Law, and the vacation premium of at least 25 % on them. A seniority premium of 12 days a year is added on resignation only after 15 years of service. On MX$40,000 a month with two full years, leaving at the end of June, the finiquito is MX$20,804 gross. Part of it is exempt from ISR, Mexican income tax, under article 93 of the ISR law, which leaves MX$19,307 net.
How the month you leave changes the amount

The aguinaldo share grows from January, the vacation share from the work anniversary, so the two clocks rarely line up. If you have some say over your last day, leaving in late November rather than at the end of March more than quadruples the settlement. A small salary pays almost no tax because of the exemptions.
What to check before you sign
Employers usually hand over the finiquito with a document confirming the job has ended. Compare each line with this calculator: daily wage (monthly salary divided by 30, article 89), aguinaldo days, vacation days owed and premium rate. Multinationals often grant more than the legal minimum, such as 30 aguinaldo days or a higher premium, and your contract or company policy prevails when it is better than the law.
If you are leaving Mexico, ask for the payment before your exit date and keep your payslips and the receipt: you may need them for your annual tax return. Your Afore retirement account and any profit-sharing (PTU) for the year are separate from the finiquito.
Finiquito versus severance

Frequently asked questions
I am resigning to move back home. What goes into my finiquito?
Everything you have earned and not yet been paid: outstanding salary days, the pro-rated aguinaldo for the calendar year, pro-rated vacation since your last work anniversary and the vacation premium on it. On MX$40,000 a month, two full years and a departure at the end of June, that comes to about MX$20,804 gross and MX$19,307 net. Nationality and relocation make no difference.
My fixed-term contract is ending and will not be renewed. Am I owed a finiquito?
Yes. When a fixed-term contract simply runs out, there is no dismissal and no indemnity, but the accrued benefits are still due under the Federal Labour Law: the proportional aguinaldo (article 87), proportional vacation days (article 76) and a premium of at least 25 % on them (article 80). Enter your dates in the calculator as you would for a resignation.
Is vacation I did not take last year paid out when I leave?
Yes, with its vacation premium. If you earn MX$30,000 a month and leave just after your first anniversary with all 12 days unused, the finiquito adds MX$12,000 for the days and MX$3,000 of premium. Enter them under untaken vacation from earlier years. Keep proof of the days you requested and were refused, in case the employer disputes the balance.
Will my final payment be taxed like a normal payslip?
Less heavily, as a rule. Article 93 of the ISR law exempts the aguinaldo up to MX$3,519.30 and the vacation premium up to MX$1,759.65. Only the rest is taxed with the monthly tariff. On MX$25,000 a month with one year, a finiquito of MX$14,041 has MX$4,958 exempt and MX$94 of ISR withheld. Your annual return settles the final figure.
Can I claim severance pay if I resign?
Not after a plain resignation. Severance, 3 months of pay and possibly more, is owed when the employer dismisses you without cause, or when you end the contract because of the employer’s serious breach, such as unpaid wages or a cut in pay (article 52 of the Federal Labour Law). In that second case use the severance calculator instead, and get legal advice before signing anything.
